These Terms & Conditions (“Terms“) govern your purchase of products from Collectable Arms, LLC (“we,” “us,” “our,” or “Company“) via the website www.collectablearms.com (the “Website“). By accessing the Website, placing an order, or purchasing any product, you (“you,” “your,” or “Buyer“) agree to be bound by these Terms. If you do not agree to these Terms, do not use the Website or place any orders.

1. Compliance with Firearms Laws & Conditional Sale

All purchases of firearms, frames, receivers, suppressors, and other regulated items are conditional upon full compliance with all applicable federal, state, and local laws, including but not limited to eligibility requirements, background check approval, and transfer through a licensed Federal Firearms Licensee (“FFL“).

By placing an order, you represent, warrant, and certify that:

  • You are legally eligible to purchase, possess, and receive the items you order under all applicable federal, state, and local laws.

  • You are at least 21 years of age for purchases of handguns, frames, receivers, suppressors, and any other items requiring such age under applicable law, and at least 18 years of age for purchases of long guns where permitted by law.

  • You will provide valid, government-issued photo identification reflecting your current residence address at the time of transfer or pickup.

  • You will comply with all applicable waiting periods, permit requirements, residency restrictions, transfer procedures, registration requirements, and other legal obligations in your state of residence and the state of transfer.

  • The items you are ordering are legal to purchase, possess, and receive in your jurisdiction.

  • You are not purchasing any item on behalf of another person who is the actual buyer or recipient (i.e., a “straw purchase“), which is a federal crime under 18 U.S.C. § 922(a)(6).

  • You are not prohibited from purchasing or possessing firearms under 18 U.S.C. § 922(g) or any state law.

We reserve the right to cancel any order if we have reason to believe that completing the transaction would violate any applicable law.

2. Jurisdiction-Specific Restrictions

Certain items we offer may be restricted, prohibited, or require special permits in certain states, counties, or municipalities. These restrictions may include, without limitation, magazine capacity limits, feature restrictions, ammunition restrictions, permit or licensing requirements, and outright prohibitions on certain firearm types.

It is solely your responsibility to know and understand the laws of your jurisdiction before placing an order. We do not provide legal advice and make no representation that any item is legal for you to purchase, possess, or receive. If you are uncertain about the legality of any item in your jurisdiction, consult a licensed attorney before ordering.

We reserve the right to refuse or cancel any order for items that we determine, in our sole discretion, may not be lawfully shipped to or possessed in your jurisdiction.

3. Order Fulfillment, Dropshipping & Transfer

  • Inventory is fulfilled through third-party distributors and licensed FFLs. We may not physically stock each item listed on the Website. Product descriptions, images, specifications, and availability are subject to change without notice.

  • All firearms and regulated items will be shipped only to a licensed FFL or made available for pickup at our location in Crawfordville, Florida, as required by law.

  • You must designate a receiving FFL at checkout or select in-store pickup. You are responsible for confirming that your designated FFL will accept transfers and for any fees charged by that FFL.

  • Title and risk of loss for firearms and regulated items pass to you only upon completion of all required transfer paperwork and your taking physical possession of the item.

  • We are not responsible for delays caused by FFL availability, background check processing times, waiting periods, or any other legal or regulatory requirements.

4. Pricing, Availability & Order Acceptance

  • All prices are listed in U.S. dollars and are subject to change without notice.

  • The listing of any item on the Website does not constitute an offer to sell. Your placement of an order constitutes an offer to purchase, which we may accept or reject in our sole discretion.

  • We reserve the right to cancel any order prior to transfer or shipping due to inventory unavailability, pricing errors, compliance concerns, suspected fraud, or for any other reason. If we cancel your order, we will notify you and refund any amounts paid for the cancelled item(s).

  • We are not liable for typographical errors, inaccuracies, or omissions in product descriptions, pricing, or availability.

5. Payment

  • Payment is due at the time of order. We accept the payment methods indicated at checkout.

  • All payments are processed by our third-party payment processor. By submitting payment, you authorize the charge to your selected payment method.

  • You represent that you are authorized to use the payment method provided and that the information you provide is accurate and complete.

6. Refunds, Cancellations & Failed Eligibility

  • If you fail to meet legal eligibility requirements, including background check denial, and the transfer cannot be completed, the order will be cancelled. In such event, we will refund the purchase price of the firearm only. Transfer fees, FFL fees, shipping charges, and any other fees are non-refundable.

  • Once you complete the transfer and take physical possession of a firearm or regulated item, the sale is final. No refunds, returns, or exchanges will be accepted.

7. Returns & Exchanges for Non-Firearm Items

Non-firearm items (accessories, gear, apparel, etc.) may be eligible for return only if:

  • The item is in unopened, original packaging;

  • The return is requested within seven (7) days of receipt; and

  • The item is not otherwise designated as non-returnable.

Approved returns will be issued as store credit only—no cash refunds. A restocking fee of 10% may be deducted from the credit amount. Buyer is responsible for return shipping costs.

8. Indemnification

You agree to indemnify, defend, and hold harmless Collectable Arms, LLC, its owners, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your breach of these Terms or any representation or warranty made herein;

  • Your violation of any applicable law, regulation, or third-party right;

  • Your purchase, possession, use, or misuse of any product purchased from us;

  • Any dispute between you and a third party, including any receiving FFL; or

  • Any fraudulent, negligent, or wrongful act or omission by you.

This indemnification obligation shall survive the termination of these Terms and the completion of any transaction.

9. Limitation of Liability & Disclaimer of Warranties

DISCLAIMER OF WARRANTIES: EXCEPT FOR ANY EXPRESS WARRANTIES PROVIDED BY THE MANUFACTURER, ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY PRODUCT WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

LIMITATION OF LIABILITY: TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL COLLECTABLE ARMS, LLC, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE OR PURCHASE OF ANY PRODUCT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

MAXIMUM LIABILITY: OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR ANY PRODUCT SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO US FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

ESSENTIAL PURPOSE: THE LIMITATIONS AND EXCLUSIONS IN THIS SECTION APPLY REGARDLESS OF WHETHER THE CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND SHALL APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

10. Dispute Resolution & Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Informal Resolution: Before initiating any formal dispute resolution proceeding, you agree to first contact us at collectablearms@gmail.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute by contacting you via email. If the dispute is not resolved within thirty (30) days of your initial contact, either party may proceed as set forth below.

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Website, or your purchase of any product that is not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA“) in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted in Wakulla County, Florida, unless the parties mutually agree otherwise or the AAA rules provide otherwise.

Class Action Waiver: YOU AND COLLECTABLE ARMS, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.

Exceptions: Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.

Opt-Out: You may opt out of this arbitration agreement by sending written notice of your decision to opt out to collectablearms@gmail.com within thirty (30) days of your first purchase from us. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of this arbitration agreement.

11. Governing Law & Venue

These Terms and any dispute arising hereunder shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

For any disputes not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in or serving Wakulla County, Florida. You waive any objection to such jurisdiction or venue, including any objection based on inconvenient forum.

12. Force Majeure

We shall not be liable for any delay or failure to perform any obligation under these Terms if the delay or failure results from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, labor disputes, government actions, regulatory changes, failures of third-party suppliers or FFLs, pandemics, or interruptions in utilities, communications, or transportation.

13. Privacy Policy

Our Privacy Policy, available at [insert link], describes how we collect, use, and share your personal information. By using the Website or placing an order, you consent to the collection, use, and sharing of your information as described in the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

14. Electronic Communications & Notices

By using the Website or placing an order, you consent to receive electronic communications from us, including order confirmations, shipping notifications, and other transactional communications. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

15. Intellectual Property

All content on the Website, including text, graphics, logos, images, and software, is the property of Collectable Arms, LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions, which shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties’ original intent.

17. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Collectable Arms, LLC.

18. Entire Agreement

These Terms, together with the Privacy Policy, Refund & Returns Policy, and Shipping & Transfer Policy, constitute the entire agreement between you and Collectable Arms, LLC regarding your use of the Website and purchase of products, and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

19. Modification of Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Website with an updated “Last Updated” date. Your continued use of the Website or placement of an order after any changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
